MyFinePix Copyright & Trademark Policy

MyFinePix respects the intellectual property of others, and we ask our users to do the same. If you believe that any of your copyrights or trademarks have been infringed on the Services, please follow the procedures below.  Procedures for violations of U.S copyright law are different from those of other jurisdictions.  See below to ensure proper compliance (Capitalized terms used but not defined herein shall have the meanings ascribed to them in www.myfinepixusa.com's Terms of Service).

Trademark or Copyright Violations (other than U.S. Copyrights)

To report infringement of trademarks or copyrights other than a U.S. copyright, please send the “Required information” specified below to copyright@myfinepix.co.uk :

Required Information:

  1. The jurisdiction under which the owner of such intellectual property rights has been granted such rights and the type of intellectual property right being infringed.
  2. Identification of the work(s) claimed to have been infringed.  If you seeking to protect multiple works, a representative list of such works must be provided.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit MyFinePix to locate the material.
  4. Information that enables MyFinePix to contact you, including your telephone number, address and e-mail address.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the owner, its agent, or the law.

IMPORTANT: 

  • You must provide MyFinePix with all of the “Required Information” above in order for your complaint to be reviewed.
  • Please be advised that if you materially misrepresent that a product or activity is infringing on an intellectual property right, you may be liable for damages, including costs and attorneys’ fees.  If you are uncertain as to whether there is an infringement, we suggest that you consult with an attorney.
  • MyFinePix and its affiliated companies maintain a policy not to accept any non-public ideas submitted by members of the public in order to avoid possible future confusion between such submitted ideas and ideas of our own, and to avoid restriction of our own original research and development activities. More information on our policy for submitted ideas is available at this site’s Terms of Service.

U.S. Copyright Violations

  1. If you believe your rights under U.S. copyright law have been infringed, in order for action to be taken by MyFinePix, you must send a formal notice of infringement to FUJIFILM North America Corporation’s designated agent (“U.S. Copyright Agent”) via the contact information listed below.  Notices of copyright infringement sent to the U.S. Copyright Agent via e-mail should have the subject heading “NOTICE OF COPYRIGHT INFRINGEMENT”.

  2. Any notice of copyright infringement must contain the information below in order to be addressed:
    1. A physical or electronic signature of the owner, or a person authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed.
    2. Identification of the copyrighted work(s) claimed to have been infringed.  If the complaining party is seeking to protect multiple copyrighted works, a representative list of such works must be provided.
    3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit MyFinePix to locate the material.
    4. Information sufficient to permit MyFinePix to contact the complaining party such as a mailing address, telephone number, and an electronic mail address (we recommend providing several means of communication).
    5. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
    6. A statement that the information in the notification is accurate, and, under penalty of perjury, that the complaining party is the owner of the copyrighted material or is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  3. If you materially misrepresent that any material or activity is infringing on a copyright, you may be liable for damages, including costs and attorneys’ fees.  If you are uncertain as to whether there is an infringement, we suggest that you consult with an attorney.   
  4. If the U.S. Copyright Agent receives a notice of copyright infringement that meets the above requirements, then MyFinePix will:
    1. Inform the poster of the reported content that a notice of copyright infringement has been sent with respect to the reported content (such poster will be given the opportunity to file a counter-notification), and
    2. Remove the posted material. 
  5. If the poster of the reported content elects to file a counter-notification, such counter-notification must be sent to the U.S. Copyright Agent (see contact information above).  Counter-notifications sent to the U.S. Copyright Agent via e-mail should have the subject heading “COUNTER-NOTIFICATION.”
  6. Any counter-notification must include the following information in order to be addressed.
    1. A physical or electronic signature of the member who posted the reported content.
    2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
    3. A statement under penalty of perjury that the poster of the reported content has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
    4. The name, address, and telephone number of the poster of the reported content, as well as  a statement from such person that he or she:
      1. consents to the jurisdiction of Federal District Court for the judicial district in which his or her address is located, or if his or her address is outside of the United States, of Westchester County, New York, USA, and
      2. will accept service of process from the person who filed the applicable notice of infringement or an agent of such person.
  7. If you materially misrepresent that any material or activity is not infringing on the copyright(s) of others, you may be liable for damages, including costs and attorneys’ fees.  If you are uncertain as to whether there is an infringement, we suggest that you consult with an attorney.
  8. If the U.S. Copyright Agent receives a counter-notification that meets the above requirements, then MyFinePix will:
    1. Provide the party who filed the notice of copyright infringement with a copy of the counter-notification, and inform such party that that MyFinePix will re-post the reported content, and
    2. Re-post the reported content on the site within 10 to 14 business days of receipt of the counter-notification (unless, prior to that time, the U.S. Copyright Agent receives notice from the person who submitted the original notice of copyright infringement that such person has filed an action seeking a court order to restrain the poster of the reported content from engaging in infringing activity relating to the reported material – such notice should include a copy of the filing with the court).
  9. A copyright owner or a person authorized to act on the owner's behalf may, under certain circumstances, request the clerk of any United States district court to issue a subpoena to MyFinePix for identification of an alleged infringer.  Such subpoenas must be sent in accordance with the Digital Millennium Copyright Act and the Federal Rules of Civil Procedure.
